Terms of Service

1. Eligibility

You must be at least 18 years old to use ReelSwap.

By creating an account, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• All information you provide is accurate and current.

2. Marketplace Role

ReelSwap is an online marketplace that allows users to create listings and communicate with one another regarding fishing-related equipment and services.

ReelSwap:

• Does not own, inspect, store, ship, or sell listed items.
• Is not a party to transactions between users.
• Does not guarantee the accuracy of listings.
• Does not guarantee payment, delivery, quality, condition, legality, or safety of items.

All transactions are conducted solely between buyers and sellers.

3. User Accounts

You are responsible for:

• Maintaining the security of your account.
• Keeping your login credentials confidential.
• All activity that occurs under your account.

You must immediately notify us of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listings

Users may create listings for lawful fishing-related items and equipment.

You represent and warrant that:

• You own the item or have authority to sell it.
• The listing is truthful and accurate.
• Photos accurately represent the item.
• The item complies with all applicable laws.

Listings may not contain misleading information, fraudulent claims, or deceptive pricing.

5. Prohibited Items and Conduct

Users may not list, advertise, sell, or promote:

• Stolen property
• Counterfeit goods
• Illegal products
• Firearms, ammunition, or weapons
• Controlled substances
• Hazardous materials
• Fraudulent services
• Items that violate intellectual property rights
• Any item prohibited by applicable law

Users may not:

• Harass other users
• Engage in scams or fraud
• Attempt to manipulate listings or reviews
• Create multiple accounts to evade enforcement actions
• Scrape, copy, or harvest Platform data without permission

6. Fees

At launch, ReelSwap may provide listings free of charge.

We reserve the right to introduce:

• Listing fees
• Premium features
• Subscriptions
• Advertising products
• Other paid services

Any applicable fees will be disclosed before purchase.

7. User Communications

The Platform may provide messaging or communication features.

You agree not to:

• Send spam
• Send malicious links
• Harass or threaten other users
• Impersonate another person

We may monitor, review, or remove communications where permitted by law.

8. Transactions

Buyers and sellers are solely responsible for:

• Negotiating transactions
• Inspecting items
• Determining payment methods
• Arranging pickup, delivery, or shipping
• Resolving disputes

ReelSwap does not guarantee that buyers or sellers will complete transactions.

9. Safety

Users are responsible for exercising caution when interacting with others.

We recommend:

• Meeting in public locations
• Bringing another person when appropriate
• Inspecting items before payment
• Avoiding wire transfers and suspicious payment requests

ReelSwap is not responsible for losses resulting from transactions conducted through the Platform.

10. Content Ownership

You retain ownership of content you submit, including photos, listing descriptions, messages, and profile information.

By submitting content, you grant ReelSwap a non-exclusive, worldwide, royalty-free license to display, reproduce, modify, and distribute such content for purposes of operating and promoting the Platform.

11. Intellectual Property

All Platform content, branding, logos, software, design elements, and intellectual property owned by ReelSwap remain our exclusive property.

You may not reproduce, distribute, or exploit Platform content without permission.

12. Reporting Violations

Users may report:

• Fraudulent listings
• Copyright violations
• Prohibited items
• Harassment
• Suspicious activity

We reserve the right to investigate and take action at our sole discretion.

13. Account Suspension and Termination

We may suspend, restrict, or terminate access to the Platform at any time for:

• Violations of these Terms
• Fraudulent activity
• Abuse of the Platform
• Legal or regulatory requirements

We are not obligated to provide advance notice.

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REELSWAP DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF INFORMATION, AND AVAILABILITY OF THE PLATFORM.

We do not guarantee uninterrupted service or error-free operation.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REELSWAP, ITS OWNERS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS, PROPERTY DAMAGE, PERSONAL INJURY, OR TRANSACTION LOSSES ARISING FROM USE OF THE PLATFORM.

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT PAID TO REELSWAP BY YOU IN THE PRECEDING 12 MONTHS, WHICHEVER IS GREATER.

16. Indemnification

You agree to defend, indemnify, and hold harmless ReelSwap and its affiliates from claims, damages, liabilities, costs, and expenses arising from your use of the Platform, your listings, your transactions, your violation of these Terms, or your violation of applicable laws.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles.

18. Changes to These Terms

We may modify these Terms at any time.

Updated versions will be posted on the Platform with a revised effective date.

Continued use of the Platform constitutes acceptance of the updated Terms.
